you will probably get 3 points o your licence
You will shortly receive a NIP (notice of impending prosecution)

Complete and return the form and you may be offered a speed awareness course. 38 in a 30 may be too fast, from personal experience I think the cut off is 36 mph. You have to pay around £100 but there will be no licence endorsement.

so 14 days have gone since it happned so it looks like it may of not been me?
Did the course about six years ago. If offered, bite the bullet,do not moan about the unfairness.

Oddly enough I have just received a NIP ,, 36 in a 30 zone.

Quiet road, no fixed cameras, just a sneaky ******** with a mobile gun. A lot of similar roads are targeted in this way to fill the coffers up.

Excellent.
If it's over 14 days it looks like you can use the "David Beckham" defence if you get a NIP now, unless, of course, you've changed your address and not told DVLA.
Going of experience, if it's a busy road and the camera is going off all the time, they run out of film quite quickly and there is a good chance that there was no film in it. Good luck anyhow.
"so 14 days have gone since it happned so it looks like it may of not been me?"

I don't want to rain on your parade, but are you the Registered Keeper of the vehicle (i.e. do you hold the V5c registration document) and is your name and address on it and correct in all details?

The "David Beckham" defence is only applicable if smartypants is not the Registered Keeper(RK) of the vehicle. Mr Beckham was not the RK of his car and only the first NIP (to the RK) is subject to the 14 day rule. Mr Beckham convinced the court (with the testimony of the RK - Bentley Motors) that the first NIP did not arrive in time.
