Car Accident Help
7 Answers
Hi,
I was in a car accident earlier but not sure who is at fault.
I was at a cross junction I had stopped to check both sides were clear as I wanted to go ahead. There was a car coming down the road from my right they were indicating left to turn into the road I was leaving. As the got closer and was preparing to turn I then went ahead as they seemed as though they were turning left. As I went they turnt the corner late (I assume) as she hit my car (hit my right side with her left) so even if she did turn it was very late as she was turning into my side of the road almost. I mean technically she turnt late but my parents seem to think as I was joining her territory before she left it it could be my fault in terms of insurance. I have protected no claims etc just really panicking as don’t want to have to pay her costs.
Thanks

You should not assume what indicators mean; for example, she might have been indicating to pull into the left just after the junction. You NCB is protected, so you won't lose any of it but your premiums might go up anyway because you will be classed as a higher risk. The best you can do is LEARN from the experience; we all make mistakes but learning from them makes you a better driver.
they dont want to go through insurance that is strange if there is damage to your vehicle i would inform your insurance company
If it is a t junction and you are on the bottom of the t and someone on the too of the t turns to the bottom and hits your car then it is their fault they did not continue straight they turned and hit your car which was in a different lane to the one they should have been in who can say is at fault but to me it doesnt sound cut and dry and they sound more to blame

I believe you will be considered to blame for the reasons given by bgh (big hungry giant ?). But, who knows, you may get a percentage of responsibility shifted for a misleading signal. May as well go through your insurance.
BTW was she really turning right, or just trying to avoid the crash by turning ? Could be an indicator that didn't self cancel, or an intent to park just past the junction.

If I read this correctly, you are at a crossroads intending to cross the major road to go straight on. A vehicle is approaching the same junction from your right but is indicating to turn left, leaving your exit and crossing therefore clear and safe to carry on. If you combine other factors with a turning vehicle, such as loss of speed on their approach or an indication of intent, I think you are correct to proceed. The fact that the other vehicle did collide with your car in the way you describe means they took the turn too quickly or the driver was incompetent in the manoeuvre. It would not be seen as reasonable for you to have waited until the other vehicle completed the turn as you might still be waiting there now, to exit. You MUST inform your insurance company as offences seem apparent.
