a dealer who won't replace a faulty part
I had a new engine replaced in my vehicle due to a defect in the original. Sadly the new engine failed due to a manufacturer's defect [so I'm told by my garage]. I have beein contact with the dealer and supplier of the engine, and written to them a few times, and they've refused to acknowledge my letters or infact do anything about the problem. The dealer alledges the manufacturer of the engine won't replace it whilst the manaufacturer says the dealer says hasn't contacted them to claim a replacement on warranty.
What should I do?! It's an expensive car and has been sitting in a lock up for about six weeks now.

For more on marking an answer as the "Best Answer", please visit our FAQ.Get a solicitor on the case. The dealer clearly is responsible for fitting a faulty engine. He should replace that and settle with the manufacture himself. You didn't deal originally with the manufacturer so you don't have to now.
The dealer may well have fitted a moody engine into your car. The manufacturer will of course be able to tell this, which is why the dealer is reluctant to contact them. They will just keep denying responsibility hoping you will go away.
One bit of important advice "dont leave it to long before you get advise because the longer you leave it the less chance you have of the garage having to put it right"
I had 8 months battle over a car that was faulty,i won my case in the end.It didnt get to court because the finance company met my demands as they knew i was right.If no finance company involved it will be easier as you deal with the dealer.I got back the deposit they took for my car in part exchange and they took the car back without me owing them a penny for year i had it.They mucked me about so much i got disheartened with the car i just wanted rid of it .It took 7 months trying to get them to repair it and they didnt want to know.When they knew they were fighting a losing battle with me they only then offered the repair, i no longer wanted the car then.I never used a solicitor i wrote letters,quoted my rights from what i found on the internet consumer rights act and filed the case with the small claims court.
If you check out the legal sites on the internet you will find whos liable for what and know if you have a good case.Can be a stressful battle but worth it in the end
