My next door neighbours have rtemoved our path, after being told by the local council not too.Theirs is a bought house and ours council. The path was shared and is an implied right of way.The only access we have is through a gap i cut in my fence, that leads to my drive.People then have to walk passed my car that now has several scratches thanks to post bags, leaflet bags ect.My 20month old daughter was walking with me to the car when she tripped on the uneven surface and banged her head on the car bumper.Anyone who comes to the house has to also walk passed our living room window to the front door.not nice for my partner when breast feeding. We spend most of the day with the blinds closed. Can we claim for the injury to my child, the scratches on the car and the stress an inconvenience they have caused.

Sorry can't give advice on claims, but as you live in a house owned by the council, you need to contact them immediately.

You want to get the rights of way situation sorted and I presume the council would have all that information to hand. It could be that you shouldn't have cut a hole in the fence to get access to your drive. Two wrongs dont make a right.

I understand how you must feel, but when your neighbours initially removed the shared path, then that's the time you really should have contacted the council.

I hope it all gets sorted out OK.
