This afternoon my b'friend was in a car accident (other car pulled out in front of him).Seems that both car's are right off's. The other person accepted all liability and said he'd sort it out. When he got home to get documents I relized the MOT had just rang out (end of Sept). Even though he's claiming on the other person's insurance will this make the policy void? and what's the best and worse senario? Thanks! x
Do not mention it, should be ok. Insurance is not void without an MOT it just means that the insurers will use it as an excuse for not paying. In this case it's the other persons insurance so you'll probably be ok.
Some insurers do make it a condition that the vehicle is legal and roadworthy, or the insurance is deemed null and void.
The car was being driven illegally.
At best the other side will use the fact that the car has no mot to bring down its value in the payout.
They will certainly be looking very closely at the brakes - just because the driver admitted liability it doesn't mean the insurance company will accept that. The insurance company will be doing all they can to minimise their costs.
It must have been some impact to cause both vehicles to be written off.
Ethel, it doesn't need a big impact to have a car written off, if the cars are only worth a few hundred � to start with, a minor ding will cost more than the value of the car to repair so it will be written off.
I agree with loosehead, just keep it quiet, you may become unstuck though, because you will have to give your insurance details to the other driver, who will pass them on to his insurers who will make contact with your insurers.
May be worth trying for a cash settlement with the other driver. if the cars are low value, may not be too much money involved, and could be 3rd party only, so may prefer not to claim. (Lost NCB, excess, loaded premiums). This would eliminate the problem.
