Yes. It is not a legal requirement to have a spare tyre, but if you do have one, it must be legal.

Even if a spare is carried it is not inspected as part of the MOT test.
It only has to be legal when fitted to the car.

the spare wheel is not sublect to the mot test but the spare wheel carrier is, it must be secure .

To recap.

MOT rules.
The spare tyre is not a testable item.
If the spare is missing as long as you have no other failures, the car will pass.
If the spare is defective (bald tyre or flat) the MOT tester should give you a VT32 (Advisory form), which advises you of the problem.
The spare wheel if it's suspended under the car on a carrier must be secure.

The Law.
It is not against the law to drive a car without a spare wheel.

i work at a garage and if a mot was to be carried out correctly it would fail. you either need a spare wheel or a punture repair kit in the boot of your car. seen cars fail before for this

geggsy i have been an mot tester for 5 years and i can 100% guarantee you that a car wont fail an mot for no spare tyre whether its illegal/baldy or as a i say not even there. it will however fail if the underneath spare wheel carrier is insecure.

With the computerised system it's impossible to fail it, so geggsy you're talking rubbish.
There is no fail criteria for having no spare wheel.
The only thing mentioned about the spare in the Tester's Manual is:-
Check that any externally fitted spare wheel and/or carrier Is securely attached to the vehicle.
That's it.
If you saw someone fail a car for that, he was wrong. End of story.
