police caution
Hi, everyone!
I am so upset and I can`t hold back the tears! I have only just found that I have caution for battery on my CRB when I aplyed for a new job in a different NHS hospital. I am a nurse who has been working for the past 6 years and did not have any problems with the law! Needless to say they have dissmissed my job offer and don`t want to hear about me. I had a very heated domestic argument with my husband last year and we both decided to go to the police and solve it. Unfortunately we got held up and interviewed for him pushing me to the ground and for me scratching his neck when I fell down while we argued. Becouse we are foreighn nationals we did not understand that we where cautioned and only have found out when I got my CRB check. I have raised a dispute as I feel it is so unfair when I was only seeking help from the police and that I was the victim. I now fear that I might loose my current job in the hospital. My manager knows about this but I don`t know how I stend legaly. I am mortified and extremly stressed out. Please help!

A Caution is a police record NOT a criminal conviction. So an enhanced CRB check will show it but employers should understand the circumstances and allow you to explain the reasons. When receiving the caution the duty police inspector would have expliained that you were admiting the offence and therefore the caution. Battery is the lowest form of assault and can be a scratch, push, slap etc. You don;t say how long ago this was as the longer time the better the employer will feel about employing you.
If enough evidence was available to caution it follows that you could have been prosecuted at court and then have a criminal conviction. So the police caution is a way of dealing with minor law breaks like your incident.
The caution cannot be removed and will always be on your police record, it is not a criminal conviction and if a job application states "do you have any criminal convictions' - you can answer no.
