Driving without due care & attention
6 Answers
Hi all,
I passed me driving test around 5 months ago, about a week ago i was involved in a car crash. As i approached a sharp right i skidded out of control, due to panicking i ended up with the car on the opposite side of the road and into a lamp post. I had two passengers in the car, the guy in the back broke his nose. The officer who came to the seen said i may get prosecuted for driving without due care & attention. As i have only just passed and this was a very big lapse in concentration on my part would do u guys think the implications will be? Fine, Points, both? Or Fine & license taken away?

Readheadisback I don't think this is the sort of answer Johnislania was looking for. It amazes me how people jump on here and snap back to other people's misfortunes. This can happen to anyone in a don't know what to do for the best situation.I presume you are a fully qualified driver to express your views.
Driving without Due Care and Attention comes under Sec 3 of the Road Traffic Act and in reality if it goes to court you will probably receive a fine and three points on your licence.
You could be offered a better driving course, this will still cost you in the region of 150 but it is a better option than having to go to court.
Slow down, its better arriving late that not at all, I hope the guys nose is better.

The penalty for careless driving is actually a fine of about one week's net income and between 3 and 9 points. The fine will be reduced by a third if you plead guilty. As an alternative to points the magistrates may impose a period of disqualification, but this eems unlikely from your description of the incident.
The magistrates may however decide to award more than the minimum in view of the fact that injuries were sustained to your passenger.
If you get six or more points within two years of passing your test your full licence is revoked, you revert to provisional status and you willhave to take your test (both parts) again.
