Blocking neigbors access to driveway
19 Answers
I have a neigbour who hates anyone parking outside his house and to stop this he has knocked down his front wall and laid a drive. However we live on a main road, and he has not got a dropped kerb.So if i park in front of his drive can i be fined? My local engineering department for Lancashire County Council has said my neigbour has no legal rights of accessand that the pavement belongs to them and not my neighbour but before i start blocking him in or out how do i stand with regards to the currentlaw.

This might give you an idea of what might happen.

I was told that if you block someone from getting out of their drive then they can call the police and get your car towed away but if you stop someone from getting into their drive then there is nothing they can do at all
I would suggest only parking there when there is no car parked in the drive just to be safe
I would also take notice of Whiffey's comment regarding your car getting keyed as things like this can quite often escalate outside of the law !!!

He is breaking the law each time he drives on and off his drive - it is illegal to drive on the pavement for any reason. The exception is a proper council approved dropped kerb.
You have no more right to park outside his house than he has - but if there is a free parking space and no parking restrictions you are as entitled to park there as he or anyone else is.
Take a photo of him driving across the pavement. :)

That is easier said than done sometimes panic button. My fiance and I live in a terraced street where there are no driveways or garages etc.,my fiance always tries to park directly outside our house but sometimes our neighbour's visitors are parked there so he has to park outside the other neighbour's house. He always moves the car as soon as the visitors have gone though.
an easy remedy from the council point of view , is for them , to place a CONCRETE POST , in front of his unofficial driveway , meaning he cant access it anymore.... and when he has decided to have the KERB DROPPED at his own expensive giving him the right of way..then the council , can consider removing the "concrete post ".... however the council placing a concrete post , is about as unlikely as the Italian natinal football team , appointing an English born manager !! , but it could clip his wings , meaning the resident , with unofficial DRIVE WAY..
I live in Leicester and I asked the City Council the same thing, I built a drive on the front of my house but I didn't have a dropped kerb and when I asked them about it they told me if my car was on my drive and there isn't a dropped kerb then I don't have the right to drive on there pavement and they can fine me a lot of money.
So I paid 250 to the council to have my kerb done and then I can legally drive over the pavement onto my property.
So carryonken just report them to the council and they will deal with it....

Oh come on this is Lancs... how short on parking can you be?
Do you know whether or not your neighbour as applied for a crossover? He may have had the drive done before the council are able to come and do the pavement.
Some councils in London have been cementing those great big wooden posts outside people's driveways who haven't had a crossover put in. Not much to do with this situation I know... just councils playing silly ******* spending their budgets.
Just point out the situation and tell your neighbour they had better put in a crossover pretty damn quick.

My neighbour is the same, she hates everyone parking outside of her house and she has a seperate driveway and garage to the side and only has one vehicle so she doesn`t even park outside her house herself. So to stop people parking there she put in a drop kerb even thou she hasn`t got a garden to park in. The front of the property is right on the pavement and South Glos Council let her do it. I contacted the council and asked them why they let her when she only wants it to stop people parking there and they told me that they gave her permission by mistake, saying the guy who went out to inspect it was his 1st week on the job and he thought the pavement in front the property was part of her house and said to me want do you want us to do? I said make her put it back the way it was. the council guy said but we will have to conpensate her and I said so. They don`t know what to do? I then ask well can she stop people parking there because even thou there is a drop kerb you are not blocking in anyone nor stopping anyone get to and from their property. They said she could call the police if someone parked there but the poloce couldn`t do anything because you are not bocking anyone so yes anyone can still park there if they wish, so she wasted a lot of money for nothing and still the council hasn`t done anything about it. So if anyone wants a drop kerb put in and the council refuses tell them about this and fill free to contact me I will send you pictures. Another case of one rule for some and anyother rule for others.
