Involved in a accident and have found out that my mot has ran out

Help, i didnt realise that my mot was out of date, and i have been involved in a car accident, my car is a right off, i am fully comp but does this stand now the mot is out of date? The other car involved is saying it was my fault so the insurance company is saying that it is a split blame, as i think it was their fault, Police were involved, but nothing was mentioned to me at the time about the mot. Where do i stand.?

well we all know how insurance companys try to get out of paying up,so you may be up a creek,
my mates car was parked up overnight outside his houes and was hit by another car and written off, because it only had a couple of weeks test left they reduced the value of his car

It depends on the Insurance Company - They may still pay out but will probably deduct a percentage from the settlement figure. Not sure how you stand with the police though

Invalid insurance sadly.

Technically the car would have been un-roadworthy.

No MOT also invalidates the road tax.

I have known for insurance accessors to inspect car's after accidents and find bald tyres and other faults and not pay out.

The DVLA sell information to the insurance companies, so ALL the digital information on insurance is obtainable.

i dont think this does invalidate your insurance, gouldc will probably confirm this as he/she has answered this question on here quite often.

Ask your local traffic police officer or better still ring your insurance company.
Under the road traffic act, I think you will find that you do need an MOT.
That sadly is the LAW, but in a way a good law, after all you wouldnt want an unroadworthy car with no brakes going towards a crossing with your children walking across it would you ?.
Dont Drink & Drive - Always have insurance and a MOT.

I'm working for an Insurance Company at the moment - on the Total Loss team - They will pay out if the MOT has run out, but deduct a percentage from the settlement. If however they find that there was a defect on the vehicle that caused or contributed to the accident, then they wont pay out.

Thanks for every ones answers, Havent told the insurance company yet, Worried what they will say! Will have to own up, My stupid mistake so will have to pay for it
