my and daughter and her friend park the car up on the right side of the road parked cars on ether side and her freind was getting out of the passenger side when a diver hit the side of there door , who is at fault

I think you will find that it is the person who opened the car doors fault. When you think about it, if it was the driver of the other cars fault then nobody would drive past a parked car in case somebody opened a door as they went by??

If your Daughters friend was poening the door in the path of the oncoming traffic without first checking if it was clear, then it was your daughters friend to blame.
I'm not sure where the diver comes in - was it parked on the quayside?

If the passenger alighted from the car onto the highway (in the way of other traffic) they caused a hazard on the highway and are at fault.

That's why drivers are taught to use mirrors before opening car doors.

Since she was a passenger the driver who owns the olffending vehicle will be held liable for allowing their pasengers to alight into traffic. The offending driving can then sue the passenger for their losses.....and lose a friend!
Debra is at fault, for having a daughter who allows such an idiot numpty to be a passenger in a car said daughter is driving.
When your driving are you not supposed to be the width of a car door away from parked cars?
