The earliest you can get it done is one month before it's due. You then get an MOT for 13 months.
You can get it done and passed now but it will date from the day you get it Mot'd
Like I said above. See half way down the page here http://www.ukmot.com/when%20mot.asp

An MOT can be carried out at any time

If the vehicle is tested within the calendar month prior to when the MOT is due, the test certificate will run from the date of the test to one year after the expiry date of the current certificate. For example, if the current certificate was due to expire on 1 April 2007, and the vehicle was presented on or after 2 March 2007, the certificate would run from the test date until 1 April 2008.
Don;t be silly, of course not.

Oh yes you can !!

I do this every year - my wife's car was due 21/12 do I took it after 21/11 it passed and now it's MOT'd until 21/12/10

You need never run foul of the law because you always have a current MOT and the computer does it automatically
I do it every year after December 2nd because mine is due on the first of January and no one is open that day.2nd of December is the earliest I can take it.It tells you all this on mot certificate.
