Private Parking Ticket

I have received a private parking ticket for parking outside my sisters house on private land. The machine printed ticked quotes the correct registration number but shows the make of car as a Toyota. It is actually a Nissan. On that basis, I do not own or was driving or parked a Toyota with that registration No? Do I have a good argument for appealing the ticket?

I would definitely try to challenge it. I would have thought a mistake like that would invalidate the ticket. You could argue that as they have the make of car wrong, who`s to say they haven`t got the registration wrong too and your car wasn`t even there at the time.

You do not 'appeal' them because they are a request for payment based on an assertion by the landowner (or the landowner's agent) that a civil contract has been established between the car owner and the landowner.

Binning it might not be great advice, private parking companies can and do take people to court for breach of contract resulting in a hefty fine.

You have more chance of contesting it if you can prove that there were not clearly visible signs informing you of any parking restrictions, if there are clearly visible signs then you entered into a contract by parking your car there and if you failed to adhere to the requirements of your side of the contract (either paying or displaying a permit) then the parking company can sue you for breach of that contract.

If you bin it .. and a summons ensues .. at last minute, dispute it based on vehicle details. It's very likely to be dropped.

Here is what you do.
1.Write to them and say you are the registered keeper of Nissan reg no. ABC 123D or whatever.
2. State that several people have access to the vehicle and you have been unable to ascertain who was responsible for parking the said car on the said date
3. Ask THEM to provide evidence of who was responsible for parking the car on the said date etc (this covers you in the unlikely event there is a CCTV camera or their parking attendant snapped you on camera. If they do provide the evidence, youu will have to stump up)
4. State in your letter that unless THEY can provide evidence of who was responsible for the parking contravention, you do not want to hear from them again
5. If they continue to write, ignore the letters.
6. UNDER NO CIRCUMSTANCES should you pay and then appeal - you will never see your money again.
Trust me, this strategy works.
