Section 4A Public Order
Hi,
On the 29th of December just past; me and a freind were arrested for the above. This occured after an argument occured over a previous fued with a takeaway owner. My friend got into an argument with him about the facts and figures of it; for the record I was charged with D&D after beleiving I was short changed - to which I still do, I pleaded guilty and was fined £180 12 months ago. After being interviewed and going through the takeaway owners statement it's apparent that it is completely fabricated and summarises how 'the men' were racist towards him. I have strongly denied this and I also beleive there is CCTV proving that I was no where near the guy when apparently 'the men' have said this. Apparently it wasn't recording - which is odd because we were arrested 200 yards up the road after being followed by it. My friend has also strongly denied the racist part of it but has however said that they did indeed have a conversation; to which, there were no threats or intentional distress meant. Anyway, after 22 hours in a cell we were released at the same time on bail without conditions to reappear on the 28th of Jan. The officer whom let me out said 'we are trying to get hold of someone for another statement' - at this point they only had one; which, strikes me as odd. My freind is is a senior NCO in the forces who has no previous, I, unfortunately have been charged with D&D and Racially aggravated harrasment previously to which I was fined a small amount on both occasions the most recent was exactly 12 months on the day I gotarrested. We both plan on pleading not guilty if it does in fact get that far. Any advice, suggestions or experience on how something like this will proceed? I'm firmly under the impression that the guys statement is a way of getting me hung out to dry because of the previous occurence to which he obviously wasnt happy about. Also, without going into a terrible amount of detail his statement is very vague suvh as 'the men' 'they' - there is no specific. He has also been incorrect about what he thought I did for a living and other things such as he thought I have been to Afghanistan and that I spoke Pashto?? Beats me.
