What is the likely fine, points on licence for driving a car without a MOT

On 04/09/06 my daughter took out insurance on the car having purchased it from me, in good faith that it had a MOT. Unfortunately when I sold her the car I had missed the MOT renewal which would have been picked up when I came to tax the car at the end of October. On 21/09/06 my daughter was involved in an accident, although not her fault, the third party is disputting this fact. Given that she was driving the car without an MOT, will she be fined and have points put on her licence, even though I am still the registered owner of the vehicle, yes forgot to change that as well. Also as she has held her full licence for less than 12 months, due to my ****-up will she have to retake her test?

I'm sure you don't want a lecture but clearly owning and driving a vehicle carries some serious responsibilities. You should have made sure the car was road legal and transfer ownership promptly to a new owner especially if its to your daughter and she has responsibility to check this herself. All I can suggest is that you get the V5 (log book) completed and sent to DVLA smartish to transfer ownership as you implied you haven't done this. There could be a serious problem if your daughter has taken out insurance as the owner of the vehicle if it is still in your name as this may invalidate the claim. I can't help with your queries and I guess your daughter should seek legal advice.
I hate to say it, but the lack of an MOT can invalidate insurance on most policies although individual circumstances may vary. Driving without an MOT in itself normally attracts a minor fine which generally doesn't attract points, but the insurance issue may or may not come into play. In the event of any prosecution being brought then I'm sure you'll both take advice from somebody suitably qualified.
