I was parked on the corner and next to a dropped down curb outside a shop. I know I wasnt meant to park there but I just popped in to the shop, when I returned to my car someone reversed into it smashing the head light the driver of the other car is saying that it is just my fault because i should not of parked there,i know this but he still shouldn't of reversed into my car but I say it is more his fault. Who is right?
You need to take it to your insurers - but at the end of the day, they hit a parked car. Hitting a stationary object is their fault. They may argue that it was difficult to see because of where your car was (wrongly) parked, but if you were stationary they should have no excuse for hitting you at all.
yes, I don't know of any law that says if a car is parked illegally other people are allowed to crash into it! But if you were so close to the corner that someone drove round it without being able to see you, that might make a difference
if another vehicle hits yours on a public highway thats technicaly a road traffic accident ,it should be reported to the police just in case you claim off your insurance.
When you are the 85th person of the day who just "popped into the shop" and parked illegally to do so, the neighbours will hate your guts. It's still no excuse though to hit your car, he is legally in the wrong.
