Where do I stand after reversing out of my driveway and coliding with a car driving along the pavement from five doors down the road in order to use the dropped kerb outside my house. Instead of using a closer dropped kerb near her house.
I would say you had a cast iron case for claiming against her,she shouldn't be driving on the pavement wheras you are allowed to cross the pavement if you are using a drop kerb outside your own house
You neighbour shouldn't be driving on the pavement, but for your own protection you should reverse into your drive and drive out. It's safer, it allows you better vision and protects pedestrians. Please don't say it's difficult to reverse in that's no excuse.
Did you hit them or did they hit you? Is your damage on the back of your car or the side? If it's the side of your car then you have a better argument that they hit you and therefore it's their fault.
They shouldn't be on the pavement, but then again you should expect the unexpected when crossing a pavement - it could have been a pedestrian running.
