Roundabouts

I was approacing a roundabout indicating to turn right and proceeded to move into the right lane and then onto the roundabout after checking it was clear to my right. To my left, a van had stopped giving way to me, however once on the roundabout, another road user has came onto the roundabout from the vans near side without giving way, hitting my front near side. The insurance compay is trying to say its split liability, even though i was already correctly on the roundabout and she failed to give way

From what you have said you are in no way to blame !

tell your insurers you dont accept 50/50 liability.

did you get the van driver to witness for your insurance claim?

unfortunately not. The van driver drove on. Shame!!!

you give way to traffic on your right, therefore the person who was on the right has right of way...

quote the law from the highway code (regarding right of way) to the insurance company

tell your insurance company that you will be changing insurers if they decide to go for 50/50

Insurance companies will always try and go 50/50 if at all possible so stand your ground and dont let them wriggle out of it.
