I was caught speeding 59 in a 50 by a mobile speed camera on the 14/10/07 , i returned my nip form informing of intent to go to court (reasons below) 25/10/07 , recieved a court date of 15/04/08 on the 13/03/08 does this mean they have exceeded the six month rule if such a thing exists , or do they play by different dates such as 28 days after first letter sent ie 22/10/07 all confusing eh !
Secondly i intend to put accross the point that firstly i was speeding to avoid an rta as the person to my left on the dual carriageway spotted the camera van , braked veered accross towards my car and as i was along side moving ahead considered speeding up the only wise action as braking on a curve could have led to an accident. I also plan to ask why the road has a 50mph speed limit , as its a dual carriageway in a rural area , i think i know the answer as they are insalling more cameras hard parking areas to make more money , if the reason is safety then since 2004 when the speed limit was introduced and the speed cameras appeared the accident rate has increased by 75% ..... does anyone think i have a case.
or should i just turn up and pay my fine !

As far as speeding up to avoid an accident, they will say if you were overtaking somebody who was already speeding, and suddenly braked and veered across to your lane upon seeing the camera, then clearly you must have already been speeding before you sped up to avoid him.
They will have you either way. Even the courts are biassed against you, so dont count on a fair hearing by a judge.
They aren't even interested in it being a money making set up. Many of them are, but you will never win that arguement.
I got a �570 fine and 6 points in a case where they could not even proove I was speeding. There were loads of inconsistancies in their evedence, and the whole case was based in interpritation rather than hard fact, but I still got stuffed.
Swallow your pride, and pay up. Three points and a �30 or �60 fine isnt the end of the world, and the points are dropped after 3 years.
