Hit by lorry in car who drove off

My boyfriend was hit by a lorry few months ago in his car.
they were merging and the lorry just drove into him.
However the lorry driver drove off.
He got a witness and the reg so able to find him.
The witness even said it was lorry driver in the wrong.
However now insurance company are saying may have to do 50/50 on insurance?
Said if goes to court then thats all they will say.
Surely if he drove off then this is guilty conscience.
And as we got a witness to say aswel?
They're just saying be easier to do 50/50 but that means we have to pay half of excess for something that wasn't his fault?
It just doesn't sound like the insurance care that much about it and it's like easier for them to go 50/50, but it's money out of out pocket.
Can we say we want it to go to court?
Do you think insurance company are right and easier to just pay 50/50?
We reported to police also. They found him but just left off with slap ont he wrist!!

My friend has been in a similar situation, she was hit by a bus who just pulled out infront of her- and they settled 50/50. I think your insurance company would push for court if they believed you had a good chance- but they prefer to settle before as it offers a degree of certainty and reduces the cost e.g. employing solicitors when legal proceedings have been issued. I am going to court next month for a RTA and I am not guilty- but the stress is immense- I sympathise with you. Push the insurance company and when you re-new your insurance change companies if you are unhappy.
