in the witness statement by the police officer it states I was driving a van yet i was driving a lorry with no tacho is that a reason to plead not guilty.

What is the motoring offence?

The HGV you were driving was it new? where you on Trade Plates?
A 'lorry with no tacho' is either i) illegal or ii) under 3.5T GVW which I would call a van.
