Motor Incident - What are they trying to achieve

About a month a go I had two people hing round my hanging round my car and I believed they were breaking in. When I went over they claimed I had hit their car as we park next to each other in the residential parking for the flats. However, their van had not been there when I drove in that night and they had no idea when this incident had taken place and also no witnesses. The only evidence they had was a red mark and my car is red and had a scrap from a pillar in the office car park I used that dates back to the summer. We agreed to go through insurance to sort it out, however two weeks ago the van returned all fixed up and we assumed they had realised it wasn;t my fault. However, this afternoon I have returned home to see a note from the police wanting to discuss the incident - which they now claim happened on the 30/11/09 (a day I was on holiday and didn't even use the car). What are they trying to accheive by calling the police?
I feel like they are just trying to scare me, what are the police going to do?

I'd say yes, they are trying to bully you into some kind of payment. Surely the police are only involved if for example you leave the scene of an accident? Several times when i have been hit by other h=vehicles, even when I have been able toreport their details, the police made it clear they could not give one.

I thought this too, but this is where I live and the number of my flat is on the parking space.
Also, they have already repaired the damage so I can only think they would be trying to take me to the small claims court?

you could point out to the police that you weren't there and politely suggest they may be trying to pervert the course of justice.

if it is a nore from the police saying they want to discuss the alleged incident, that's just what they want to do, they will be going through the motions as they have a duty to follow up every complaint. however, it does not mean that the police will be charging you with anything, they have to have evidence of an offence to do that and there isn't any, unless the people were taking pictures of your vehicle bacl when the accident is supposed to have happened. is there CCTV where you park or do you have to clock in and out when you leave the parking area? I am wondering why they agreed to use their insurance company and then actually contacted the police, did maybe their insurance company tell them to take a running jump?

yes its a note from the police. No unfortunately there isn't cctv but I have witnesses that I didn't use the car as I'm a captain of the netball team and I didn't go to training that evening and dropped the kit off on foot. I don't believe there are any photos but I can't be sure. Photos wouldn't show much though as they admitted they didn't know when it happened as they only noticed it on the 1st of December when I wondered what they were doing.

If it's any encouragement, I was once in collision with a chav late at night. He exited a pub with his mates, straight across the road diagonally without looking, made it to the pavement then fell off the pavement into the side of my car. Made no complaint at the scene then made a complaint next day. I had a chat with a PC round my house and nothing more came of it. Now society has become much more litigious since then, but even plod can make out you are being accused of something for which no evidence exists.

Thank you, I'm feeling alot more confident about it now. Wish me luck, I'll be speaking to the police on Monday as its the next time they are available. I'll make sure it doesn't spoil the NYE celebrations.

Are you sure this note is really from the police? Don't be bullied, tell them that you want to know what proof they have that you damaged the van.You have no knowledge of being involved in an accident and feel that the other people are "trying it on". Good luck

I love a challenged like this Reality, my way with this, get your evidence in writing regards where you where, time,date, the witness name, Get the color code off your ID Plate under the bonnet, check if the paint on the pillar, is it still there? if so, get a sample, ask the dead legs for the address of the garage that done the repairs & state that your Insurance will be going there to ask Questions If poss get a witness to listen to this conversation, just see how they respond to this I would then visit the police station with your facts, I would also state to these two that I intend to clear this up in court ( This I would do I CAN ASSURE YOU) you are being slandered here, but beware there could be repercussions here.
