Leaving the country whilst on licence.
3 Answers
Hi, my partner was recently released from prison and he will be on licence until october 2013. My question is regarding been able to leave the country. Obviously his licence means he is unable to leave the country legally but would the probation service know about him leaving England if he comes back in time to sign probation? I know that their is the risk of people telling the authorities etc but would the passport control know when he arrives at the airport/ferryport.
My 2nd question is similar but slightly different. If my partner left the country whilst on licence but stayed out of the country until his licence had expired what would the punishment be? I was told it would usually be a 28day sentence or would he be given the original remaining time on licence to be spent in custody?
I hope this makes sense. Any info would be deeply appreciated.

If UKBA officials carry out the full checks which the Home Secretary keeps insisting on them doing, their system will flag up your partner's return (if not his departure) as being relevant to information held on the Police National Computer. He would then be arrested and immediately returned to prison, to serve the FULL licence period behind bars.
For example, if your partner's licence period is one of 18 months, and he breaches his licence conditions in September 2013, he will have to serve the full 18 months (NOT just the remaining 1 month) in prison.
