Charged With Gbh With Intent Section 18
10 Answers
My ex (my babies dad) told me last week that he had been charged wi gbh with intent section 18. He only told me this as he had to return to the police station last Friday night as a witness had come forward.
My ex told me that his windows had been out through twice since New Year's Eve and that he saw three lads looking though his windows.
He then carried to say that a few weeks ago he was getting ready for work, turned the landing light out and looked out the window and there was two lads staring towards his house at the top of the backings outside his house, he then went downstairs and watched through the blinds to then proceed to get the keys to the back door upon which he the. Picked up a hammer and asked the lads what they was doing, one lad ran down the backings and one ran the other way, my ex chased the one down the backings and throw the hammer at him, which hit the lad in the back, my ex then beat the lad up and kicked hi in the head and also picked the hammer back up and hit the lad in the knees smashing them. I am totally mortified at what he has done. My ex told me had dumped the hammer.
He is pleading not guilty and he thinks he is going to get away with it and the charges dropped. What is the likely hood of this happening?.. Or how long of a sentence is he looking at.
And what happens now he answers bail on the 28th February, although he is due to fly to Portugal Tuesday and he reckons he doesn't know his bail conditions which I reckon he is lying as he probably knows he can't the country.
Me personally think he is going to jail and he deserves it too. It will be me left picking up the pieces as when he get out our daughter will not know who he is as I will not be allowing her to go visit, she has just turned one.
Any info or advise/your opinions on this would be much great full.

Does your ex have a history of mental illness?
Is there any need to be involved?
As far as I can see the only info you have is that he is going abroad and possibly that he told you he disposed of the hammer, but I think given the injuries that won't make any difference. If he is your ex you could leave him to sort his problems out. You could advise him to tell the police about his holiday but maybe the question will be covered by bail conditions anyway. If you tell the police he may know it was you and it could spoil your relationship even more

His mum also said his windows had been put through and no he didn't report this. I don't really want to be involved was just after advise as to what kind of sentence he would get. He said he is unaware of his bail conditions as he just wanted to get of the cells. I have tried speaking to him but he just gets all up tight about the situation. I guess there is nothing I can do, it was just so I had an idea of how long he could be sent to prison for.

Standard bail conditions do NOT prevent a person leaving the country but if fails to answer bail at the designated time he will have committed a criminal offence by doing so. (That applies even if the person is later found not guilty of any other offence or has all charges dropped). So if your ex is out of the country when he should be answering bail he will be arrested upon his return and probably held in prison until his trial.
If your ex does answer bail at the specified date and time he might well be simply re-bailed. Such cases usually take well over a year to get to court (with 15 to 18 months being common).
>>>how long of a sentence is he looking at
Your description of the events seems to rule out any possibility of it being classed as a 'Category 3' offence (which is the least serious level). It will probably be classed as 'Category 2', which has a 'starting point' sentence of 6 years imprisonment, with a range of 5 to 9 years available to the judge:
