The Neighbouring Pub Which Is Situated Approximately 10 Feet Above The Bridle/footpath That Divides Us Has Installed A Raised Area In Their Beer Garden, Next To Their Fence. Anyone Standing There Is A Good Head And Shoulders Above The Fence And The Area

Is directly opposite my bedroom window which is about 10 feet away. I believe this is an invasion of my privacy, do I have legal grounds for complaint? Furtehermore, one of their customers threw a lit cigarette over the fence which landed on a leaf and smouldered for some time. If it had fallen straight down, it would have landed amongst very dry grasses next to the wooden fence! Given the expected long hot, dry spell I fear that there could be a major fire. I intend speaking to the landlord tomorrow but would like to know where I stand legally.

Ring the planning office at your local council in the morning and ask them the same question. If the shape and size of it doesnt require it to have planning permission, then ask to be pit through to the environmental health dept to lodge a complaint about fire risk and noise.
