Another on about trees!!!
At the bottom of the garden of the house where my Mum lives there is a tree that has been there as long as she as lived there. (25 years)
About 5 years ago someone new moved into the house which my mums house backs on to (So basically they share a boundary line.) When this new person moved in he took down the fence seperating the two gardens and built a six foot wall. Now he has complained to the local council that the tree is damaging his wall. The council inspector visited my mum's home but she is still waiting to hear their response.
Anyway this is really worrying my Mum.
Surely as the tree was there a long time before the wall, the builder of the wall should have been aware of potential damage. Can my Mum be made to pay for the removal of the tree? I am not sure if this makes a difference but it is a council property and that tree was there when my mum moved in.
Also, I know it was built about five years ago but would man who built the six foot brick wall, needed planning permission?
