i was orginally charged with ABH and admitted to putting my hands round my girlfriends neck for a few seconds, grand bail and went back and being charged with common assut and appearing in magitrates court

my girlfriend made originally statement saying what happened and also said it was out of character and i never done anything like this before - she made an additional statement saying that she doesnt want further action taken, origianlly also said she wasnt prepaid to stand in court and does not want to press charges, she is willing to write a letter to the judge for the day of my sentence, in my interview i accepted and admitted what i did, so i persume i need to plead guilty as i know what i have done and aware it is very wrong, this does seem as thou the police are perusing this as she has made it clear she doesnt want to

can anyone give me any advice or what im likley to expect in court next week.

also i have no previous convictions and i am not like that in my nature, this was a night out drinking between me and her that got out of hand, and she has clearly said this in her statement and also that she provoked this situation,

a case that is totally out of hand and both of us just want it to be put behind us, any advice would be very welcome thanks

ment in the above to say: 'granted bail' and the day of the court hearing not the sentencing.
Hi

Common assault starts on page 23 of the attached guideline:

http://sentencingcoun...ine_-_Crown_Court.pdf
In cases of domestic assult the normal course of action now is for the CPS to proceed even if the victim does not want it to go ahead.
So the case is probably out of your and your girl friends hands.
The good news is that common assult is very rarely if ever a prison sentence.
Hi Shakespearian is right once you have pleaded guilty in Court it doesn't matter whether the victim wants to prosecute or not. When you attend Court for sentencing you can expect to get some Community Service and some type of Probation Supervision requirement. Unfortunately with Domestic Violence assaults the Courts have to be seen to be doing something.
Oh yes you can go to jail for common assault in a domestic setting. I did six weeks in a category B jail for a first offence at 40years old with not even a parking ticket previously. My partner/girlfriend lied at the time and is 'apparently' very sorry for this.
It was a year ago and luckily I managed to survive and get back on track. Trust no-ones advice that you wont possibly go to jail. Thats what everyone told me.
Also, because it will be heard in a magistrates court you will not have the benefit of a jury to hear 'all' the facts and form their own opinion nor take into account the accusers previous history. As far as the CPS are concerned now its all about results, Kpi's and being 'seen' to tackle domestic violence. Its very disturbing what I, and others witnessed.
