Have any divorcees experienced this?
After a divorce and the husband is ordered to leave the marital home, {the mortgage being in both names} to allow his ex-wife and children to move in, will the court have the power remove his name from the mortgage or will he have it forever around his neck affecting his credit rating if she is unable to make payments on time or scupper his chances of buying a property for himself later if the building society are chasing him for derelict payments. I don’t see much in the way of justice for the male divorcee but if he is going to be held responsible and is dependent on the good will of a vindictive ex it seems a bit harsh. I thought that I read it somewhere that the court is able to do so but it must be done at the time not later.

For more on marking an answer as the "Best Answer", please visit our FAQ.If the male is excluded by the court from the matrimonial home for whatever reason his name will remain on the mortgage document unless the mortgage provider agrees it should be removed, which is unlikely, the mortgage provider will not care who pays the mortgage as long as it is paid and in my experience the male is unlikely to contribute under the conditions you describe.
If mortgage payments are not made the mortgage provider will eventually start the repossession process and both named on the mortgage document will be jointly and severally liable. It is unfortunate but not unusual for divorce to lead to lower living standards and difficulty with credit.
