Take a look at the pictures of that poor old ladies injuries, and honestly say that a ban from driving for two weeks (whatever that will do) and a paltry £100 in compensation, (whiplash claimants have received much more than that) and 150 hours of unpaid work is a fitting sentence?

For more on marking an answer as the "Best Answer", please visit our FAQ.have you any idea that a slap to an elderly person can be as bad as a punch, that it can break the skin, which it obviously did looking at the pictures, and cause massive bruising. heaven forbid i see him on a road, he would get a slap from me, and i would expect to be treated as leniently. read some of the comments on that thread, very few think he should have ducked jail time.

For a charge of common assault to be bought about 'there is no injury or injuries which are not serious'. Anything more than that and the charge is either Actual Bodily Harm or Grievous Bodily Harm.
I agree the photos look bad but it is a fact that older people tend to have thin skin.
I don't like to think of anyone of any age being assaulted in any circumstance but this is the correct sentence for a first offence of common assault.

it is indeed awful, and he had no need to do this to her ... but what the hell was she thinking getting out of the car and raising a hand to his face?
she says it was to stop his language? how exactly would that work?
i am not defending his actions at all, of course, i'm just gobsmacked that this woman thought it was acceptable to hit him in the face - no matter how hard it was - just because she is old and a woman does not mean she is allowed to hit people, because they block her in the road.
if someone raised a hand to me and hit me in the face they would very likely get a smack back.
it is a mistake to think that all old people are weak and feeble - they are absolutely not.
there are plenty of stories about old people being violent and nasty
an independant witness verifies that he just lashed out backhanded at her to get her away from him, in reaction to her hitting him - perhaps he thought he was being attacked? - she may be old but that doesnt make her incapable of smacking someone in the face - obviously.
everyone is angry at him for his impatience with her - but remember it was her who got so impatient she got out of her car and confronted him!
he stopped presumably to show her how annoying it is to be held up by the car in front, probably said to himself 'lets see how she likes it' - he did not do it with the intention of physically assaulting the woman ... in fact he didnt even get out of his car!
as i say, its an awful thing to happen, and in hindsight he knows he over reacted, and she did not deserve the wounds she received, (though as has been pointed out here, older peoples skin is more fragile so even a slight whack would create more severe looking damage than on a young person)

i know a girl who thinks its hilarious and acceptable to hit men... she does it because its a laugh, she knows most of them wont retaliate - she's an idiot obviously, and i warned her that one day one of them will kick the crap out of her, girl or not (she thinks because she has kung fu experience that she is 'hard') and i also noted that one day one of their girlfriends may be watching and they will hit you back ... because if you hit my boyfriend i would break your nose.
i was also once 'push/punched' in the face by a girl once, for no other reason than i was talking to her fella - a man i'd known for about 10 years, (i had known her for that long too) - she was mad at him for some other reason, and hit him then just turned and hit me too.
I reacted instantly and hit her back ... then i found she was pregnant - but i was then the big baddie because i'd 'hit a pregnant woman'... which is of course very bad, on the surface, but of course the circumstances were not that straightforward - in my mind, if you are pregnant you should not be risking hitting people in the first place, especially not ones who are out on a night out and been drinking, and if you do, you have to accept that you may get hit back.
but it irritates me that some people think various things about them make it ok to hit other people with immunity, and then become outraged and shocked when they get hit back.
