I had an accident a couple days a go. Basically the shorter version is I'm pulling out of my works car park on to a main road turning and I make it to the middle of the main road when then next thing I know is a big Yamaha R6 has gone in to the front of my car and the rider over the bonnet! The bike hit the driver's side and has pretty much taken out the front of the car. I've had a call from the garage it got taken too they have said the car is a write off.
The road where this happened has a bend on it so from where I pulled out you can only see about 70 meters up the road before the bend...and it was this direction that the bike came from. I know he wasn't coming down that road when I pulled out, I mean why in the world would I pull out if their was something coming! Anyway I pull out while looking to my right (nothing coming) as I move further in to the middle of the road I glance back to my left to double check their still nothing coming that way and then wham...
I'm pretty lost on what to do as I've never had a accident before - been driving 7 years. I've contacted my insurance and the police were also involved but I'm still lost as to what's going on. I not sure who is liable for the accident (although by law I'm the one that pulled out so it does not look good for me) but I'm arguing that the biker must have been going faster than the 32mph he says he was (it's a 30mph road) or I would have seen him. Can I argue the speed he says he was travelling at?
I've also just got a letter through the post from his solicitors saying he trying to claim on personal injury and time off work. I've been told this is just a scare tactic to try get them to make me sign the form that way I'd be admitting liability.
I just wondered if anyone has had a similar experience and can maybe give me some guidance....As I'm lost on what to do and it has me worried sick.
