Ok no one deserves to die for it but I have often wanted to strangle the morons using their phones in the cinema! I once reached over and grabbed the phone off a guy in front and threw it down the aisle, very enjoyable! Frankly I'm amazed that cinemas have not developed some sort of sheilding to negate phones entirely, then they'd not have to show those little comedic reminders about phone usage.

I haven't read all the posts - so someone might have already queried why he is being charged with second degree murder ?

He should be charged with first degree murder
i don't think one sits there getting het up after 2 minutes of conversation, after 40 minutes of one call i was ready to tear my head off, the woman was screeching into the mobile the entire time, why, and she wasn't alone, men are as guilty, no one is quiet on mobiles, and in a small space it's amplified.
The difference surely is that a silly argument (just or unjust) that might lead to a few punches, escalated to lethal force much too easily

because of the availability of a gun

I've fired hand guns on several occasions - they are very easy to use, much easier than sticking in a blade or overpowering someone with physical force.

The shooter's reasoning for habitually carrying a pistol would no doubt have been something like:

"if i run into a violent criminal or terrorist i could do something about it"

clearly, the reality is more squalid and tragic than that for all concerned.
perhaps because we don't know all the facts, that the person may have made disparaging remarks, that he threw some popcorn at the man, that harsh words were exchanged, it's no reason to shoot someone i agree, this is US remember, a whole different set of rules seem to apply
he was a former policeman, perhaps that is why he carried a gun, i really don't know why anyone would carry a gun, other than police, armed services, or farmers to exterminate some poor animal for daring to dig a hole.
/i really don't know why anyone would carry a gun/

the usual justification on a US license application is 'personal protection'
actually it's the right to bear arms, it's in the US constitution, writ large.
emmie

the right to bear arms doesn't entitle people to carry a concealed weapon

that is a particular license available in most (but not all) States
perhaps it was because of his former occupation, who knows.
thanks for link emmie

i will certainly feel different when/if i go back to Czech Republic!
or Canada...
Yes, though i think Canadian authorities might be more reluctant to issue than the others.

Interesting POV from Michael Moore, querying the number of guns in the USA as a reason for the number of fatalities in his 'Columbine' film

according to him, Canada has as many per capita but much fewer shootings...
Canada has few killings, USA tops the list, its not so much about the weaponry perhaps but the mindset of it's citizens. Mix drugs, guns,
booze, guns, gangs, guns, and a right to bear arms at any cost mentality then you have a recipe for disaster. That is perhaps simplistic, and having been to US a couple of times, there were definitely places i would have felt safer with an armoured tank.
my then b/f had been held up at gunpoint numerous times, the last time being just before i arrived in the country, he was coming to meet me at the airport, and told me how bad he felt, scary stuff...

/but the mindset of it's citizens./

quite so emm, i think that was MM's hypothesis

/my then b/f had been held up at gunpoint...he was coming to meet me at the airport, and told me how bad he felt/

I bet he told you they'd nicked the very expensive present he'd got for you...

:-) xxx
actually he was remarkedly composed, it had happened before, the present didn't materialise, actually he was a bit of a loon, but that's another story.
/actually he was a bit of a loon/

LOL xxx
we were well matched at the time, i have calmed down a bit since then.
by the way i loved being in the US, they were undoubtedly some of the nicest people i have ever met, polite, kind, and very helpful, strange that such people can be so set on killing one another with weapons more associated with the battlefields
That's what sitting next to somebody fiddling with a phone does to you!

Illegal it may not be, but irritating in the extreme it most certainly is.
