Can someone explain to me how it is that this man has been cleared of this offence. I truly do not understand.

Thats why they have Advanced A.I.s at most Divisional Traffic Units. All this will/would be carefully investigated before a case goes to court.
Strange this. The first person I saw killed in my lifetime was old George our school lollipop man. Ballards Lane. Finchley outside Clarke's College. I had just got off the bus and was walking down the short drive to the entrance. Big screech of locked up tyres.I looked around and saw old George poker stiff with right arm still stretched out holding his lollipop stick flying backwards and upwards for about 15 feet. He was about 70yrs. I reckon he was dead before he hit the road. Always thought it strange that a young girl,from my school,dashed into the road and retrieved his lollipop stick and then reverently laid it behind the telephone kiosk where he left it. Never forget that to this day.
The lollipop man a mile from us was knocked down and killed by a girl. Whitnesses said they saw her texting and speeding. However she got off as well because she said the sun blinded her.

In my book If you are blinded by the sun and you knock someone over then you are not driving with due care and attention to the conditions of the road.
So what are you suppose to do when you can't see all of a sudden?
You stop.
If you don't know, don't go.

What is that suppose to mean?
Blinded by the sun is a valid defence, as is sneezing and being stung by an insect.
If you cannot see your way ahead, you stop.
You do not go ahead.
"Don't know, don't go"
Driving blindly is highly dangerous.
An emergency stop on a busy road could also lead to a pile up.

Different on a wide road with lay bys or stopping places.


All this happens in a split second.
How ridiculous and impractical.
Being blinded by the sun can happen in a second, you can't just suddenly slam on your brakes when there's traffic around you. I expect in this case they looked into it thoroughly before they made their decision.
If you continue driving while dazzled by a setting sun, you are a menace to all other road users, and yourself.
If you cannot see your way ahead, you stop.
Would you slam on then?

On any road regardless of what is behind you?

Make all those decisions in less than the blink of an eye?

There are such things as accidents , it's my opinion this is one.
No wonder there's pile-ups on motorways if you stick rigidly to that Pete. I assume the same also applies to fog.
And the cars behind you that have also just hit the blinding sun can't see you've stopped in the middle of the road...

It would be more dangerous to stop. You could be out of it in seconds.
So, why is the emergency stop part of the driving test?
And what is really scary is that drivers coming in the opposite direction can also be blinded by the sun reflecting off mirrors and other vehicles.

The law recognises that no-fault accidents happen. And rightly so

Vulcan - we're talking about stopping suddenly because you can't see; there may or may not be a problem in front of you. The emergency stop in the driving test is to enable you to demonstrate to the examiner that you can stop quickly and safely WHEN you see an incident in front of you.
So, why is the emergency stop part of the driving test? So if he had seen the woman he could have attempted to stop, obviously.
You drive according to the conditions on the road.
It is dangerous driving to proceed if you cannot see.
You stop.
No one mentioned "slamming", or motorways.
I said, "stop".
Dangerous driving is an offence.
