The Prisoners and Criminal Proceedings (Scotland) Act 1993 provided for prisoners serving 4 years or more to be eligible for release once two thirds of the sentence had been served; the Prisiners (control of release) (Scotland) Act 2015 amended this so that prisoners sentenced to four years or more for sex offences and 10 years or more for other crimes will no longer be entitled to automatic early release from prison at any point in their sentence.
thus in this case as the sentence was 9 years and there was no sexual offence, the Prisoners (control of release)(Scotland) Act doesn't apply - although you are correct, he won't be out in 4 years, more likely six.

Yesd, I do have a certain amount of sympathy with the point made by TTT, however, our assailant didn't set out that day to kill his victim, he did that out of uncontrolled rage.
The sentence was correct.

TTT...just between the two us, and I know this won't go any further, but I too am unhappy about the length of the sentence.
A young life has been cruelly cut short and one can only imagine what his family must be going through.
But I am unclear about your comment about "the left" ? This has nothing whatsoever to do left or right, but has everything to do with the statute of law and its application in Scotland.

Given that evidence, it is not clear why the charge was lessened from murder to culpable homicide (or whether the jury was offered both charges and chose the lesser one). I would have thought that a) taking a knife into school, b) brandishing it and c) stabbing someone in the chest with it, leading to their death, was murder. It's not as if we all carry knives and knuckledusters around, is it?

Maybe in future you should let us know in the OP what answers you want. From what I'm reading the post is about the sentence of the perpetrator...
It would seem the accused had previously searched the difference between murder and homicide on his lap top. He then apparently was surprised and commented,"You are charging me with murder" when told by the police.
Also looked up previously ,'how to get rid of someone annoying.
That,to me, does not signify a spur of the moment reaction by this killer. A knuckle duster is quite a difficult offensive weapon to come by these days.
It does not appear suddenly by magic.
Probably this little charmer will end up like one of the Bulger killers. Throw away the key.
