Capping claims will ( for less serious injuries ) will undoubtedly lower costs to the industry

1.In my experience , the percentage of payouts without medical evidence is small .

2.Obtaining medical evidence is not going to deter claimants , because it is the defendants who have to cough up for the costs

3. It is very difficult to disprove that a claimant is not suffering from whiplash ( back / neck pain )
I i say to the examining doctor that my neck hurts - it's impossible to prove that it doesn't .

I don't see how that claim can be made .
However the capping will certainly reduce the overall costs .

Whiplash should be deemed to be an accepted risk that can't be claimed for.
I know that whiplash can be very painful and the effects can last for months, but so can twisting an ankle when a woman wears high heels.

The fraud that has been gong on with whiplash, has been happening for years, and there are a lot of guilty people involved, not the least the medical personal who have been signing all the documents.

Medical opinion is that whiplash can be caused by a low velocity impact .
So the medical personnel in his/her reports cannot say that a person presenting themselves, is faking a hurting neck / back

Doctors get at least £300 for the medical report.
Lawyers get a nice earner.
Patients can get a windfall of up to £4,000 or thereabouts.

How can these plans filter out the cheats?

Also whiplash injuries can cause serious disabilities.......a sort of concussion....headaches, dizziness and limb weaknesses.
