I dont think it is thieving
but ... home invasion - which is you know kinda different

and yes I dont think he will have much difficulty in saying he did it in self defence- [- you cant chase them around the house and shoot them in the back....]

no no I am not dreaming - it would be lawful to shoot someone in these circumstances ... I mean how many thieves do you know that wear ballyclavas ?

Times change I mean for chrissakes a police man has just shot a fella with a knife and no one has even whispered: "o I say that is a bit much - what is wrong with pepper spray ?"
