He was driving in Belgium, Mamya.
It's not legal. In Belgium it's an offence of Level 2 (carrying €110 on-the-spot fine):
Using a hand-held mobile phone when driving.
But he wasn't caught or reported in Belgium.

What ever the local traffic laws are is no excuse .
He is ( or should be aware - and if he isn't , it's frightening ) aware of the potential consequence of his actions.

no but we think it through before we post 3T- -
it would have to prosecuted in the local arena
and no one is gonna do that - and I am not sure if a ct in gloo-mania or wherever can take a licence away from a Brit

BUT free-tee - there are some crimes ( not Road traffic ) which can be prosecuted cross border - piracy, air piracy, terrorism, some sex offences under the 2003 act - erm spring to mind.
In France the traffic cops are prone to pocket the fines themselves- - - oo-er let justice be done!
