I would have thought wanted for a state - crime in Thpain ( plotting the dissolution of the Kingdom - er of Thpain this is!) isnt one
a similar law in germany would have rendered saying I think West Gemany and East Germany should be united, liable to prosecution

The sedition charge is a non-runner
Spain has accused the former Catalan president of rebellion. The nearest equivalent in Germany is High Treason. But it ruled that in Mr Puigdemont's case there was no element of violence, so the charge was inadmissible.
However, the court said there could be a case to answer for misusing public funds last October in order to hold an unauthorised independence referendum. So it released him on 75k euros bail whilst enquiries into that are made.

it is worth that Mansfield LCJ (*) got it right in 1762 (!) in R v Wilkes, let justice be done even tho the heavens fall !

It is a pity during the Gina Miller cases about Brexit that then Lord Chancellor didnt say the same about the judges - that they were there to interpret the Law and not to run in an election about whether Gina had a case or not

If you look at the history of Catalonia you may see they have a valid claim to independence, it all seemed to be a case of democracy in action, and the parliament voted overwhelmingly for it

NJ; I wish the Acacia Avenue residents the best of luck, but I doubt if their credentials for being considered for independence match those of Catalonia :0)

What always strikes me as wrong in these matters is that such a small majority can force a change. If you follow polls in Catalonia you will see that it is quite even and would depend almost what day it was and what the weather was like as to whether they voted for independence or not. In my opinion if you don’t have A or B then a simple majority is all that should be needed, but if you already have A then it should take a greater majority to force a change to B.
