Confused the hell out of me also. As you quite correctly asserted the primary aim is to prevent the commission of the crime and not stand by and abet it.
Of course there is a matter of observations.In some occasions an officer would have to satisfy himself a suspect has fulfilled certain criteria (ingredients if you like) before he can justify the suspicion of intent. //
With the benefit of your experience, I must confess that I was in error in saying that you cannot arrest someone for what they might do - because that is clearly not the case.
What I should have said was, you cannot arrest someone for what you think they might do, which is based on a potential act that is not evidenced at the time.
So yes, I would agree that you can arrest a man if he appears to be preparing to drive his car when he is unfit through drink or dugs, but you cannot arrest him for 'potentially killing a child' - which was the inflammatory observation on which I commented, but I did not state my position clearly, and I am happy to stand corrected.
