Perfectly so, Corby. But such decisions have a habit (if not challenged) of becoming "convention." There's nothing to stop one of M'Learned Friends saying, in his closing speech "Members of the jury, you may remember the case where the Colston Statue was dumped into the river in Bristol. That was done because of a genuinely held belief...etc. etc." Whilst it will be for the judge to direct the jury as to the validity of that argument, it is customary for closing speeches by both sides to proceed unimpeded and the damage will have been done. If this appeal for clarity finds in the A-G's favour, that damage is less likely to be inflicted.
