Police Caution For Exposure
I was at a wedding last night, couldn't get a taxi so decided to walk. Half an hour into my walk I had to pee. No where open at 3am so turned up a entry into a dark carpark. Whilst relieving myself, lights can on at the other end of the car park. PSNI! I tried to walk away but they stopped me. Took a photo of the crime and said I was exposing myself. I didn't get fined but they took my details and gave me a slip which I stupidly binned. I remember looking at the slip and they had spelt my surname wrong. I also remember them calling the station to get a RU number? But nobody picked up so the slip was incomplete and they got tired waiting. They told me that I wasn't getting a fine but the crime will be on my enhanced dbs for 12 months.
I was drunk so the details arent too clear in my head.
Can someone tell me what the slip was, was it a caution?
The slip didn't have this RU number they were trying to get, therefore is it invalid?
Lastly, my surname was spelt wrongly, will it show on a enhanced dbs?

It may have been a Community Protection Warning Notice. My son got one for exactly the same offence as you. It means that the cops have found you out doing something that could be detrimental to the community but you have not been charged nor convicted of a crime. It is not a formal caution as such. It won't be on your normal record check, should anyone need to look...

My son got one for exactly the same offence as you.
It means that the cops have found you out doing something that could be detrimental to the community but you have not been charged nor convicted of a crime.
It is not a formal caution as such. It won't be on your normal record check, should anyone need to look you up, but it would appear on an enhanced record check.
All in all, not much to worry about in terms of your future prospects. But try not to get caught again as it could mean a more severe punishment next time.

it would be sensible for you to write a reflexion ( facts, events and what you learnt from it= not to do it again) and wheel it out ( the reflection that is ! not the action replay) if it bites you in the bum later on.

If what you have written is the truth you absolutely must appeal this - it was not indecent exposure.

You'd have to get at least two (of the three sitting) dumb magistrates to believe the police absolutely. In the circumstances described here it is doubtful, unless they are prepared to perjure themselves, that the police could provide sufficient evidence to secure a conviction, whether they presented it to dumb magistrates or to those who can talk.

You can only apply for an enhanced DBS through an organisation who requires you have one; like an employer.
It’s probably not worth appealing as you have no paperwork, although it does seem really harsh for a late night pee. Bored coppers hanging around in a car park needed something to do.
Rest assured that it will not prevent you from doing anything you wish to in life except work closely with children within the next 12 months.

and so you should be given a chance to make representation - once they inform you they are 'minded' to put you on the DBS list
and the reps should be
1) I am not working with children
2) there is no harm
3) nor danger of it
so listing is inappropriate

if any one is reading this as a regular ABer and has an IQ greater than 80, BAILII has the leading cases - AB v DBS and SV v DBS ( no I am not joking). Bit of a turgid read unless of course , you then have to write an essay ....

I apologise to all decent magistrates for my earlier remarks, but my experience of magistrates is lamentable. The case before mine was a guy appearing for the second time because the first time they got his name wrong. They also got it wrong this time. The defendant was much aggrieved as he had to miss work on both occasions and was therefore losing money. Surely any decent magistrate would criticise the police and dismiss the case, especially since the charge was cycling the wrong way in a one way street. But no, they adjourned it sine die which bewildered the defendant (me too) so the Court Usher had to step in and explain.
