Hi I'm new here
Whilst cutting my toe nails this morning a particularly large lump of nail flew out my bathroom window and landed in my neighbours cup of tea she was drinking outside
On drinking a mouthful of tea she choked on said nail causing her to eject her false teeth which broke on the ground
Now Mrs O'Toole is claiming I recompense her for the teeth
Am wondering if she has a case

The analysis is not correct ( the forms of action are dead and yet rule us from their grave ) ( Maitland Forms of action at common law 1909)
but tot up the forms of action - contract, trespass to person, assault, animal trespass, horse stealing etc
and the only one that is a go-er is - Negligence
Were you cutting your nails negligently?
Leaving the window open negligently I think is not enough
Then is the damage foreseeable
er Nettleship v Weston I think
and is it not too far away - (nail files causing rain crashed in Euston I suggest WOULD - be too far)
and bobs your uncle = £1000 please and worth every penny

For the sake of Her Husband, You should replace them or She might have a Paddy !
Try your local undertakers, They keep plenty in stock and tend to be a lot cheaper than a Dentist !
And if She does have a case ! Tell Her to keep Her dentures in that the next time you're angle grinding your talons.
Hope this helps. ;-)
