Dell Hell!!!

Dell sold me I server and 2 desktops when I asked for pcs and a way of connecting them so two users could access some of the same info. They were delivered when the office was closed.
They sent me a server with only 1 network slot and it came with no network cables or hub, even though I asked for all the cables I needed.
A IT friend told me I do not need the server for my requirements and it has been miss-sold and all I need is a router at �50. There is just 2 of us in the office and all we use is word excel and email.
I contacted dell to ask if my unused boxed server could be returned, they said because it was bought through the business sales side they did not allow returns. I explained hat they had sold me a �750 server suitable for 45 members of staff, and we had 2 members of staff including me!!
They said they believed the sale was correct and the server was what i required and for that reason it could not be returned.
Since I have found that the server also has a combo drive I asked for them to take off my order.

For more on marking an answer as the "Best Answer", please visit our FAQ.The paper work shows that I have got what I ordered and therefore it is their word against mine that it is not what I ordered and the salesperson I spoke to recently about what he sold me could not support the reasons why he sold me what he need but he kept saying ..."well you agreed to it!" I told the salesperson at the time I did not understand the technical order form so he told me what I had ordered.
I have tried to look into this legally as �750 is alot to lose I will try to sell in on ebay if I cannot get it returned but legally I have been told "it's their word against yours" and because it is business that does not give us certain consumer rights. We bought it on our egg card but they say the same. We are a private small firm and only bought it through dell business site as they said that was the only way to buy a pc for an office and that buying 2 pcs and connecting them could only be a business purchase.

you've basically been tricked into this sale haven't you? as you explained to the sales guy you didn't understand the technical jargon and that you only needed it for 2 people, you did not need a server and the sales assistant would have known this.

Since you purchased it on an egg card, I assume that you have actually paid for it as a consumer not a business. (Assume that the card is in one of the directors / partners names and does not say the company name on it).
If it has, you may have purchased it as a consumer and not a business. I would go back to egg and state that you wish to excercise your rights to return the goods to dell under distant selling regulationunder and that under section 75 of the COnsumer credit act you are seeking redress from them since Dell will not refund you.
IMHO this is a bit of a grey area, but if you have purchased it in your own credit card, you may have extra rights - its worth a try.
