expired mot - car crash HELP!

i bought a car last november and on the 6th october this year i was run off the road by a young lad driving to fast off a roundabout he has extensively damged my car which has now been written off to the tune of �3816. upon looking through my paperwork it has become apparent my M.O.T has lapsed. however i still have tax, i have never recieved my policy from my insurer and am feard to death of having my claim rejected as this will leave me up the chocolate river well and truley.........

my question is as we are both third party fire theft can i still claim off his insurance and get a lower rate for my car or will it be rejected...... his insurance have accepted liability, but unsure what to expect.

Only thing i can suggest is keep quiet about it but if they ask for the documents you are well and truely screwed mate!
I did think that the insurance companies will always ask for the cars docs including tax, MOT and insurance.

Keep your fingers crossed.
they dont have to ask for your docs,they can check on their databases,whether you are insured,taxed and moted,if your not,they could refuse any payout,or they could reduce your payment to reflect lack of mot.

they have asked for MOT docs and i contacted VOSA who informed me it had ran out but because i had tax on the car till the end of november its only come to light recently, as its not something you look at evey day it only comes to light when u get a reminder for you tax!!!!! i have seen online that they tend to give you a reduced sum instead leaves me hopeful but as its all thru his insurance i dont know where i stand anyone insured with more than ????
