ABH sentencing?
2 Answers
I'd like to start by saying that i am embarassed by my actions, but i could do with some advise please. I'm a 25-year old self employed landscape gardener and i was on a night out celebrating a birthday with friends at a casino when a drunk man came to our table and became obnoxious and rude to the lady croupier. A friend and I, also drunk started mimmicking what he was saying and told him not to be so obnoxious. He asked what i'd do about it, and foolishly i offered him outside for a fight. He came round the table to me and threatened me saying he'd use a knife,i pushed his head away using my head, and a scuffle followed where weak punches were exchanged, but there were no injuries. We were then both thrown out by security, outside he again came up to me and i lashed out with a single punch which left him with a bloody nose, i backed away and police arrived and arrested me.
I have been charged with abh, the harm being a swollen, bloody nose. The police officer told me that i was charged with abh rather than common assault because i'd 'head-butted' the man - although i protest that this was a 'head-push', not an ultra aggresive backswung headbutt and this hadn't caused any actual bodily harm.
The man's statement is full of nonsense saying that my friend and i started being rude to him for no reason and that i'd asked him outside for a fight and then attacked him on the way out. I expected cctv to help show what happened, but the incidents inside and out weren't captured.
I have two previous convictions, one for drink driving and then one for driving whilst disqualified where i was sentenced to 150 hours community service.
I sincerely regret what happened that night, it happened 9 months ago and i haven't been drunk since. However i was provoked into doing something which is totally out of character because the man kept coming up to me, and threatened me which was intimidating.
I have pleaded guilty to abh as i should,
