The legal limit is 35 however some Police forces have a policy of not charging if the lower reading is between 35 and 40(in order to avoid any discrepancies or any dispute as to how close to the limit you were).
If you've been charged you will get a 12 month ban and a fine, but that's what you deserve, frankly!
Actually, newtron, believe what you want, but i can honestly say that i have NEVER EVER sat behind the wheel of a car after drinking alcohol, even if it has only been a very small amount. So, although i most certainly am not pretending to be perfect, i do feel in a position to comment on this matter.
A ban is obligitory, 12 months probably for your first offence, you may as said be able to get 25% shorter by agreeing to go on that course.
Obviously its not big or clever but everyone makes mistakes and im sure most of the posters have done it at one time themselves- im not saying all of them, at the end of the day lets just be glad nothing tragic happened - a lesson learned and all that.
Get yourself a good solicitor you should be entitled to legal aid regardless of your income.
PS. where you offered the opportunity to take a blood test ( 40-50 mg you have the right to that) if not, you should point this out to your solicitor.
Whilst I agree that not all accidents are caused by drink drivers - the fact of the matter is jakagem was over the limit - end of story. It is proved that your driving is impaired whilst drinking. No I have never driven whilst under the influence. I am even paranoid about what time I should drive after a night out.
Everyone knows the rules about drink driving just as they know the rules on speeding. If you get caught you take the consequences. I know that if I get caught drink driving i will get a ban, just as I will if I get caught doing over 100 mph. No excuses, this will happen.
as to get legal aid - I really hope you don't and are not entitled to receive it. I certainly don't want to be paying for a solicitor to defend you, charging "the state" a fortune so that you may get off on a technicality even though you know you are guilty!
