guardianship of a parent

A friends father here in Scotland is suffering from dimensia and is in hospital. He will not be released from hospital unless they put him in a care home. They have found a lovely place within walking distance from their own home but the father is saying 'no' to going but obviousy does not really understand it all. They have been advised if they get 'guardianship' of him they can put him in the home. Can anyone advise on this? They really only require this to put him in a home as his wife is still fit and healthy therefore they are not looking to be looking after their finances or anything. many thanks

For more on marking an answer as the "Best Answer", please visit our FAQ.I am unsure how different the law is in Scotland on this issue from the rest of the UK but as his wife is his next of kin and she is still fit and healthy, it is almost certainly up to her to be involved in determining her husband's future. If she is uncertain how to proceed she needs to talk to a solicitor and discuss how getting a Lasting Power of Attorney would operate in this situation.
