That provides that someone who has responsibility for the animal has a duty to provide for its needs and 'needs' include providing it with a suitable environment. So the argument runs that she had taken responsibility for the cat, and a wheelie bin is not a suitable environment. All ripe for legal argument by the defence and serving no purpose. She's guilty of the other matters charged, on the evidence disclosed, and without any legal argument arising.

It would have to be proved that she caused suffering to the cat. The cats owners were not providing it with a suitable environment as it was roaming freely near a busy road it could be argued that she was preventing it from being run over by putting it in a safe place. A strange thing to do though, she could have just taken it home.
Bill Roache's family accidentally cooked their cat. It was back in the day when folk used to have an oven by the side of the fire. The poor puss got in the oven for the warmth. They didn't know the cat was in the oven and lit the fire.
