If a male and a woman are having sex and the woman is too drunk to know what's going on should this be classed as rape?

The thing is its a case of one persons word against another.

Now if they are both drunk, there must be some sort of leeway howrever if someone sets out to intoxicate a woman, then there is no difference between alcohol and a date rape drug.

There is an easy soloution, which is don't put yourself in that position, but much easier said than done.

JJ, those are extreme; the difficulty is when the woman is conscious but, say, not speaking clearly, or might be making noises that could be pain or pleasure, or might be pushing the guy away or might just be manhandling him... it can be really difficult to translate sexual movements into words in court (or in bed, for that matter), so it's the sort of situation where a jury might decide the guy has to be given the benefit of the doubt. Some rapes are obvious, but there tends to be a huge grey area, and the benefit of any doubt goes to the person accused, as it should.

you'd think so, ummmm.. I guess that it all gets cloudy when alcohol is involved.

ideally, the woman should take better care to not get so drunk that she ends up in such a situation.. equally, the man should realise there are grey areas that should be avoided at all costs.

"The Woman Is Too Drunk" Says who??? Try proving it. It's a purely subjective thing - unless of course she has just been breathalysed about five minutes before at a Police Station where the intoximeter showed her to be X times over the limit, i.e. admissible in Court as being drunk.

What would've been your thinking if lets say you found your husband cheating and he was then a woman beating drunk that abused drugs but you were trying to make a go of things but you still really hated him for all thqat he had put you through and your children (if you have any) and one night you got really drunk and woke to find him having sex with you, would this then be rape or not?
