Scotish Tuition fees mystery

Scotland has been told that because Scottish students don't have to pay Uni-Tuition fees then they must allow EU students in free otherwise it would be discrimatory. If that is so why should UK students have to pay in Scotland . I thought we were in the EU. All their thousands of rules which they churn out and we have to obey why is this one different ?

On the Student Awards Agency for Scotland site, it says,

“We will not treat you as being ordinarily resident in Scotland if your main purpose in coming here has been to receive full-time education and that you would have otherwise been living elsewhere.”

I believe you but they would have to prove it . I could move to Scotland tomorrow and at the moment no one could stop me or prove I had no intention of staying there . I could sign on at the job centre as in fact a number of students do. Once a student leaves home they mostly get places of their own . The SAA could be taken to the EU court and would have to prove their case and a student would only have to stay a short while after Uni to win their case.
There are already English graduates living in Scotland after Uni so its not uncommon.
