What sentence will my friend get for gbh charge

Hi, three of my friends were leaving a train station when two guys started on one of them, they all fought back and they are now been charged with gbh. They don't have any previous convictions and were drunk at time, will this matter?Whats likely to happen?

In 2003 (the latest year for which I can find figures), 55% of people charged with GBH received immediate custodial sentences while 37% recived community sentences. 4% received suspended custodial sentences with the remaining 4% being made up of various rarely used penalties. Obviously, these figures don't show how previous convictions and other factors affected sentencing.

If your friends plead guilty at the earliest opportunity and the 'GBH' was at a level 'just above ABH' rather than 'just below attempted murder', it's likely that they will receive community sentences. The possibility of custodial sentences (of, perhaps, 3 to 6 months - or longer if the assault was exceptionally serious), however, must still remain a possibility.

Don't think we're getting quite the full story here.

You are allowed to defend yourself with reasonable force if you think you are in danger.

So for example in this situation you're allowed to hit someone and leg it - you're not allowed to knock them to the ground and stick the boot in.

The fact that charges are being brought for gbh and not a lesser charge of assault for example means that they feel they have a reasonable chance of sucess which means they must have evidence either in the form of witness statements or the nature of the injuries sustained to say this was more than just self-defense.

It's not likely that you'll get any real idea of what punishment they're likely to get when the people here are not going to get any idea of exactly how badly your friends beat these guys up.

The fact that they were drunk is not likely to exactly gain them sympathy with the magistrate. Even less so if the 17 in your sig is your age and they are under 18 too!

They need legal advice for which they should pay.

These are serious charges - but of course they will have their version,

and it should be presented by a professional.

One of my co-employees got off a GBH charge for which he had been on remand, and of course did not do it all by himself (the defence I mean)

I was arrested 5 years ago for GBH but it was out of self defence, a girl i knew was drunk and came into my home causing trouble so i pushed he out and it ended in a fight, and i got the better of her. I was taken to court and ended up being bound over to keep the peace. basically it meant that i had to behave within a 6 month period and if i didnt then i would get a criminal record and fined �500. I too had no previous convictions. I wouldnt worry about it, you can now have 'carachter witnesses' to tell the courts what kind of a person people are, so hopefully it will all be in your freinds favour.

Having been in a simular situation, i was charged with GBH and affray, it went to Crown Court and eventually they dropped the charge to ABH and affray, as i claimed self defence the guy threw a punch at me before i sparked him out cold!!!

The ABH then got Dropped on the lack of witness statements there were inconsistancies in the 5 statements they had.

In the end I pleaded guilty to Affray and they dropped the ABH which I was facing 9 years behind bars for. So I was lucky I got a 4 month tagging order.

IF my friend has broken someones jaw without the other person giving him a reason for getting hit what is his likely punishment from courts if he he doesn't have any previous convictions

My friend had previous little scraps with a person that he has seen at the weekend heavily drunk and punched him once and appeared to of broke his jaw he doesn't have and previous convictions what is likely to happen to him?
